“The measures have a disproportionately discriminatory effect and I would assume and hope that those legislators who voted in favour of the Scheme would be aghast to learn of its discriminatory effect…”
Mr Justice Spencer

Today the High Court ruled that a key plank of the Hostile Environment for ‘illegal’ immigrants, introduced by Theresa May, is incompatible with human rights law. The Right to Rent scheme requires landlords to carry out immigration checks of tenants. The scheme was found to directly cause racial discrimination in the housing rental market. The case was brought by the Joint Council for the Welfare of Immigrants with supporting interventions from the Equality and Human Rights Commission, the Residential Landlords Association, and Liberty.
